In this notice, “we”, “us” and “our” means Skechers USA Canada, Inc., being the entity employing or proposing to employ you on the date that you receive this document, and we are committed to respecting your privacy. As part of that commitment, Skechers is providing you with this Employee Privacy Notice (“Notice”) to help you understand our privacy policies and practices as they relate to the personal information that Skechers collects about our Canadian employees (including current and former employees), job applicants, and independent contractors.
We are registered in Canada and our registered address is 5055 Satellite Drive, Unit #6, Mississauga, ON L4W 5K7, Canada.
This Notice applies if you are an employee or a prospective employee of our organization. The Notice sets out the basis on which any personal information about you will be processed by us. Please take the time to read and understand this Notice.
Personal information that we collect about you
We will collect and process the following personal information about you:
- Information that you provide to us or one of our affiliates. This includes information you that you give to us by filling in forms or by communicating with us, whether face-to-face, by phone, email or otherwise through the recruitment process and during your employment with us. This information may include:
- Your full name, date of birth, gender, nationality, education and qualification details, marital status, home address and home telephone number, mobile telephone number, next of kin, emergency contact details, the information you have provided on your application form, your CV or resume (including qualifications, employment and education history, and your job application(s) to us), any information you provide to us during the interview process, bank account details for the transfer of your salary and other benefits, pension information, Social Insurance Number and other government-issued identification numbers, proof of right to work, driver’s licence information, tax details and your date of hire; and
- Sick leave or other leave of absence information, as well as health related information provided to us by medical practitioners who are instructed by us to provide medical evidence in relation to a particular employee, including occupation health reports;
- Information we collect or generate about you. This includes:
- Work-related details such as your job position, employee ID number, business contact details, performance at work, absences, pay and benefits information and other compensation data, benefits-related data (including information needed to enrol in benefits and which plans and benefits you choose to elect), travel information such as frequent flyer number and hotel loyalty program memberships and account numbers, service history, a copy of your employment agreement, passport details or ID card, photograph or videos (for example in or outside retail stores or corporate facilities), health information, pregnancy and/or disability status (certain countries only and only as permitted by applicable law) and tobacco status (in certain countries only and only as permitted by applicable law);
- Personal information that we collect through your use of our email system, computers, devices or networks (including but not limited to your full name, email address and the content, date and time of your email correspondence, device and operating system information, internet protocol address, browsing history, search history, information on your interaction with a website or application, and any personal information stored in sharedrives or other cloud-based unstructured storage);
- Images collected in-store through Closed Circuit Television (CCTV);
- Information obtained through an exit interview with you (upon your departure from our organization), including your reasons for leaving; and
- Personal information that we collect through your employment and conduct at our premises, including but not limited to your department and supervisor, hire date, dates and hours worked and records from building or door access cards.
- Information we obtain from other sources.
- Background checks and references collected as part of employee onboarding/background screening; and
- Personal information that is provided or generated by third party recruitment platforms we use in order to process candidate data and provide analysis including ratings and scores to assist in recruiting decisions. The personal information processed includes candidate resumes, (including qualifications, employment and education history, and your job application(s) to us) as well as interaction data from career sites.
Uses of your personal information
Your personal information may be stored and processed by us in the following ways and for the following purposes:
- To meet our legal obligations as an employer, and perform our obligations and exercise our rights under your contract of employment with us. For example, we use your personal information to pay you, to evaluate your individual performance, and provide benefits in connection with your employment;
- To assess your skills, qualifications and suitably for the role you have applied for, to carry out background and reference checks, to communicate with you about the recruitment process and to keep records related to our hiring process;
- To comply with any legal or regulatory obligations to which we are subject (including compliance with any request from regulatory authorities or other relevant public authorities);
- We will use the private contact details relating to you and your next of kin (and that you have provided to us for emergency purposes) only in connection with an emergency;
- We will process personal information related to your use of our email system in order to enable the effective operation of the email system and ensure that it is used in accordance with our policies and procedures; and
- The prevention and detection of crime or fraud, including using CCTV in our stores for such purposes.
We may use your personal information for the purposes above because that use is necessary:
- For us to perform our obligations and exercise our rights in connection with your employment contract with us;
- To perform our contractual obligations with our third-party providers;
- For the purposes of occupational health and to take decisions regarding your fitness for work;
- For us to comply with our legal and regulatory obligations;
- For us to establish, exercise or defend our legal rights or for the purpose of legal proceedings; or
- For business management and planning, including:
- Allow us to effectively and efficiently administer and manage the operation of our business;
- To make suitable and informed hiring decisions;
- Ensure a consistent approach to the management of our employees and the employees of our affiliate companies worldwide;
- Maintain compliance with internal policies and procedures; or
- Contact you or your family in the event of an emergency.
Disclosure of your information to third parties and cross-border transfers
We may disclose your personal information to our affiliates for the purposes of:
- The management and administration of our business and our affiliates’ business;
- Complying with the functions that each of them may perform relating to regional or global HR decisions;
- Benchmarking employee salaries and benefits with similar organizations;
- Assessing compliance with applicable laws, rules and regulations, and internal policies and procedures across our business and our affiliates’ businesses;
- Where your personal information is held as part of an internal directory, enabling adequate communication with you for the performance of employment duties or for emergency reasons;
- Performing contractual obligations with third parties; and
- The administration and maintenance of the databases storing personal information relating to our employees or to employees of our affiliates.
We will take steps to ensure that the personal information is accessed only by employees of our affiliates that have a need to do so for the purposes described in this Privacy Notice and that they are subject to appropriate confidentiality and only use the data for purposes described in this Privacy Notice.
We may also share your personal information to third parties outside of our corporate group for the following purposes:
- If we sell any of our business or assets, in which case we may disclose your personal information to the prospective buyer for due diligence purposes;
- If we are acquired by a third party, in which case personal information held by us about you will be disclosed to the third-party buyer;
- To process candidate data, including to provide careers website services;
- To third-party agents and contractors for the purposes of providing services to us, including, IT and communications providers, law firms, accountants and auditors. These third parties will be subject to confidentiality requirements and they will only use your personal information as described in this privacy notice; and
- To the extent required by law, for example if we are under a duty to disclose your personal information in order to comply with any legal obligation, establish, exercise or defend our legal rights, to law enforcement authorities investigating a breach of law, or to regulatory or governmental authorities, including taxation authorities, as requested or required for the purpose of fulfilling their mandates or responsibilities.
All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal information for their own purposes. We only permit them to process your personal information for specified purposes and in accordance with our instructions.
If these affiliates or other third parties are located outside of your province of employment, we may transfer your personal information outside of your province of employment. These third parties may be located outside of Canada, including in the United States.
Where we transfer your personal information outside Canada, it will be protected in a manner that is consistent with how your personal information will be protected by us in Canada. While outside of your jurisdiction of residence, personal information may be subject to applicable foreign laws, which may permit government and national security agencies to access your information in certain circumstances. In all cases, however, we will ensure that any transfer of your personal information is compliant with the applicable data protection law.

Retention and storage of personal information
How long we hold your personal information for will vary. The retention period will be determined by the following criteria:
- The purpose for which we are using your personal information – we will need to keep the data for as long as is necessary for that purpose (including for the entire duration of your employment, and after the end of that employment, for any other period required by law or as set out in our internal policies); and
- Legal obligations – laws or regulation may set a minimum period for which we have to keep your personal information.
Skechers has in place technologies and processes that are intended to reduce the likelihood of unauthorized access to information and to help improve data security. These safeguards may include measures to protect against unauthorized access, alteration, disclosure or destruction of personal information (including limiting access to personal information to those of our personnel who require access for the purposes described in this notice). Internally, Skechers has policies and practices in place to restrict access to personal information to those employees who require access for the purposes described in this notice. This may include managers and supervisors, as well as employees in our Human Resources, Finance, and Legal departments.
Your rights
Under Canadian privacy laws, you may have a number of legal rights in relation to the personal information that we hold about you. These rights include:
- The right to obtain information regarding the processing of your personal information and access to the personal information which we hold about you;
- The right to withdraw your consent to our processing of your personal information at any time. Please note, however, that we may still be entitled to process your personal information if we have another legitimate reason (other than consent) for doing so;
- In some circumstances, the right to receive some personal information in a structured, commonly used and machine-readable format and/or request that we transmit those data to a third party where this is technically feasible. Please note that this right only applies to personal information which you have provided to us;
- The right to request that we rectify your personal information if it is inaccurate or incomplete;
- The right to request that we erase your personal information in certain circumstances. Please note that there may be circumstances where you ask us to erase your personal information but we are legally entitled to retain it; and
- The right to lodge a complaint with the data protection regulator if you think that any of your rights have been infringed by us.
The availability of these rights depends on your province or jurisdiction of residence and may be subject to one or more exceptions. You can exercise your rights by submitting this privacy request form or contacting us using the details set out in the “Contacting us” section below.
You have the right to make a complaint at any time to the appropriate Canadian privacy commissioner. We would, however, appreciate the chance to deal with your concerns before you approach the applicable regulator and request that you contact us in the first instance.
